1. Acceptance of Terms

By downloading, installing, or using the KTSO Radio application (“App”) on your Roku device, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you (“User” or “you”) and KTSO Radio Station (“KTSO,” “we,” “us,” or “our”).

2. Description of Service

The KTSO Radio App provides:

  • Live streaming audio broadcast from KTSO
  • Current song and artist information (“Now Playing” data)
  • Local news updates and ticker feed
  • Access to recently played songs history
  • Promotional banners and advertisements

The App is provided free of charge and is supported by advertising.

3. License Grant

3.1 Limited License

KTSO grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on Roku devices you own or control
  • Use the App for personal, non-commercial purposes
  • Access the streaming content provided through the App

3.2 License Restrictions

You may NOT:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App for any commercial purpose without written permission
  • Redistribute, sublicense, rent, lease, or lend the App
  • Record, download, or capture streaming content (except where technically unavoidable for buffering)
  • Use the App in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to our servers or networks
  • Use automated systems or software to extract data from the App

4. Content and Intellectual Property

4.1 Ownership

All content broadcast through the App, including but not limited to:

  • Audio streams and recordings
  • Music, programming, and shows
  • Logos, trademarks, and branding
  • News content and ticker information
  • Graphics, images, and user interface elements

…is owned by KTSO Radio Station, its licensors, content providers, or other third parties and is protected by copyright, trademark, and other intellectual property laws.

4.2 Music Licensing

KTSO holds the necessary performance rights licenses (ASCAP, BMI, SESAC, etc.) for broadcast transmission. Users may not use music heard through the App for any purpose other than personal listening.

4.3 Trademarks

“KTSO”,” logos, and other marks are trademarks of KTSO Radio Station. Use of these marks without express written permission is prohibited.

5. User Conduct

You agree to use the App in a lawful and respectful manner. You will NOT:

  • Use the App to transmit any harmful, threatening, abusive, defamatory, or obscene material
  • Interfere with or disrupt the App, servers, or networks
  • Attempt to bypass any security features or access restrictions
  • Use the App in any way that could damage, disable, or impair our services
  • Impersonate any person or entity
  • Collect information about other users without consent

6. Third-Party Services and Advertisements

6.1 External Services

The App connects to third-party services including:

  • SecureNet Systems (audio streaming and metadata)
  • RS Media Server (banner advertisements)
  • WordPress feed services (news content)

These services operate under their own terms and privacy policies. KTSO is not responsible for the content, accuracy, or practices of third-party services.

6.2 Advertisements

The App displays banner advertisements to support free access to content. By using the App, you agree to view these advertisements. We do not control the content of third-party advertisements and are not liable for any claims related to advertised products or services.

6.3 Third-Party Links

Advertisements or content may contain links to external websites. KTSO is not responsible for the content, privacy practices, or terms of use of third-party websites.

7. Streaming and Data Usage

7.1 Internet Connection Required

The App requires a stable internet connection to function. You are responsible for:

  • Obtaining and maintaining internet connectivity
  • All data charges from your internet service provider
  • Any costs associated with streaming audio data

7.2 Streaming Quality

KTSO does not guarantee uninterrupted or error-free streaming. Stream quality may vary based on:

  • Your internet connection speed and stability
  • Network congestion
  • Technical issues beyond our control
  • Geographic location

8. Privacy and Data Collection

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect and use information.

Key points:

  • We do not collect personal information through the App
  • Third-party services may collect IP addresses and device information
  • We do not track individual listening habits
  • Banner ads may use cookies or similar technologies

9. Disclaimer of Warranties

9.1 “AS IS” Basis

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy or reliability of content
  • Quality of audio streams

9.2 No Guarantee of Availability

KTSO does not guarantee that:

  • The App will be available at all times
  • Streams will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free from viruses or harmful components
  • Content will be accurate, complete, or up-to-date

9.3 Technical Issues

You acknowledge that streaming media is subject to:

  • Buffering and delays
  • Quality variations
  • Temporary service interruptions
  • Compatibility issues with certain devices or network configurations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1 No Liability for Damages

KTSO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Loss of use or enjoyment of the App
  • Service interruptions or downtime
  • Cost of substitute services
  • Damages arising from use or inability to use the App
  • Damages caused by third-party content or services

10.2 Maximum Liability

IN NO EVENT SHALL KTSO’S TOTAL AGGREGATE LIABILITY EXCEED $10.00 USD OR THE AMOUNT YOU PAID TO USE THE APP (WHICH IS $0.00 FOR FREE APPS), WHICHEVER IS GREATER.

10.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless KTSO Radio Station, its affiliates, officers, directors, employees, agents, and licensors from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

12. Content Accuracy and Availability

12.1 Now Playing Information

While we strive to provide accurate “Now Playing” information, we do not guarantee:

  • Real-time accuracy of song titles, artists, or album art
  • Availability of metadata for all content
  • Correctness of third-party provided information

12.2 News Content

News and ticker information is provided for informational purposes only. KTSO is not responsible for:

  • Accuracy or completeness of news content
  • Third-party news sources
  • Timeliness of updates

12.3 Programming Changes

KTSO reserves the right to:

  • Change programming schedules without notice
  • Modify or discontinue any content or features
  • Update the App without notification
  • Interrupt service for maintenance or technical reasons

13. Modifications to Terms

13.1 Right to Modify

KTSO reserves the right to modify these Terms at any time. Changes will be effective:

  • Immediately upon posting updated Terms
  • For material changes, we may provide notice through the App or other means

13.2 Continued Use

Your continued use of the App after any modifications constitutes acceptance of the updated Terms. If you do not agree to modified Terms, you must discontinue use of the App.

The “Last Updated” date at the top of these Terms indicates when they were last revised.

14. Modifications to the App

KTSO reserves the right to:

  • Modify, update, or discontinue the App at any time
  • Add or remove features without notice
  • Change the App’s functionality or appearance
  • Require updates for continued use
  • Discontinue support for certain Roku device models

You are not entitled to any compensation or refund if the App is modified or discontinued.

15. Geographic Restrictions

The App is intended primarily for users in the Tulsa, Oklahoma area and surrounding regions. While the App may be accessible from other locations, KTSO:

  • Does not guarantee availability outside the primary broadcast area
  • May restrict access based on geographic location
  • Is not responsible for compliance with laws outside our broadcast jurisdiction

16. Age Restrictions

The App is intended for general audiences and is suitable for all ages. Parents and guardians are responsible for monitoring their children’s use of the App.

17. Account and Registration

The App currently does not require user accounts or registration. If account features are added in the future:

  • You will be responsible for maintaining account security
  • You must provide accurate information
  • You are liable for all activity under your account
  • You must notify us of any unauthorized use

18. Termination

18.1 Termination by User

You may terminate your use of the App at any time by:

  • Uninstalling the App from your Roku device
  • Discontinuing access to the service

18.2 Termination by KTSO

KTSO reserves the right to:

  • Suspend or terminate your access to the App at any time
  • Terminate these Terms with or without cause
  • Block access from specific devices or IP addresses
  • Discontinue the App entirely

18.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ceases
  • You must uninstall the App from all devices
  • Provisions of these Terms that by their nature should survive will continue (e.g., disclaimers, limitations of liability)

19. Governing Law and Dispute Resolution

19.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States, without regard to its conflict of law provisions.

19.2 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma. You consent to the personal jurisdiction of such courts.

19.4 Class Action Waiver

20. Severability

21. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. KTSO’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KTSO regarding the App and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

23. Assignment

You may not assign or transfer these Terms or any rights granted hereunder without KTSO’s prior written consent. KTSO may freely assign these Terms and its rights and obligations without restriction.

24. Force Majeure

KTSO shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (natural disasters, severe weather)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet service provider failures
  • Power outages or equipment failures
  • Labor disputes or strikes

25. Technical Support

25.1 Support Availability

Technical support for the App may be limited. KTSO is not obligated to provide:

  • Personalized technical assistance
  • Troubleshooting for device-specific issues
  • Support for non-standard configurations

26. Accessibility

27. Export Controls

You agree to comply with all applicable export and re-export control laws and regulations, including U.S. Export Administration Regulations. You may not use or export the App in violation of such laws.

28. U.S. Government Rights

If you are a U.S. Government entity, the App is provided as “Commercial Computer Software” as defined in FAR 12.212 and DFARS 227.7202, with only those rights granted to all other end users pursuant to these Terms.

29. FCC Compliance

KTSO operates under licenses issued by the Federal Communications Commission (FCC). Users acknowledge that:

  • Broadcast content is subject to FCC regulations
  • KTSO complies with all applicable broadcasting standards
  • Emergency Alert System (EAS) messages may interrupt regular programming

30. Feedback and Suggestions

Any feedback, comments, or suggestions you provide regarding the App (“Feedback”) shall be deemed non-confidential and non-proprietary. KTSO shall be free to use such Feedback without any obligation to you.

31. Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.

Acknowledgment

BY USING THE KTSO ROKU RADIO APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
